tax payments

SU-TON charges the appropriate VAT or other taxes as specified for each product (except where a tax exemption certificate has been provided). Please specify which products are exempt from VAT or other taxes.

terms of payment

Payment will be made in cash, wire transfer or other approved method (all domestic payments will be in RMB only).

Unless otherwise agreed by the parties, the customer shall pay for the goods in advance. Payment may be made in the following manner only if expressly agreed upon by the parties:

a) by cheque; b) on delivery; c) invoiced within seven working days of full payment.

Freight policy

Conditions of shipment - Products shall be shipped from the SU-TON plant and shall be conditioned for delivery to the carrier (named place).

Freight Charges - Unless otherwise specified, SU-TON selects the carrier for shipment to No. 1 Sudong Road, Guxi Town, Taixing, Jiangsu Province, subject to the charges and conditions confirmed in the contract, and the customer is responsible for the cost of additional services, hazardous materials shipments, the use of the customer's nominated carrier, or the carrier's special handling of the shipment. In case of product production delays, resulting in multiple shipments of an order, the charges may be adjusted appropriately.

Risk of Loss - Risk of loss passes to the customer when SU-TON delivers the goods to the carrier and documents are processed. The product remains the property of SU-TON until paid for by the customer. If the product is damaged in transit, the customer must file a claim with the carrier and SU-TON will assist in filing a claim against its designated carrier.

limited warranty

SU-TON warrants to the Customer that for a period of twelve (12) months from the date of purchase, all Products will be free from defects in workmanship or material under normal use. If the Customer discovers a defect and the Product is still under warranty, the Customer shall, unless otherwise specified, return the Product, freight prepaid, at SU-TON's direction or to an authorised location specified by SU-TON. SU-TON shall determine whether the product is defective in material or workmanship. If defective, SU-TON will repair or replace the product or service, as appropriate, and this is all the compensation SU-TON may provide to the customer. SU-TON makes no warranties other than those set forth above. SU-TON shall not be liable for claims for product defects or warranty claims arising out of misuse, improper selection or application of the product. except as expressly warranted by su-ton, su-ton makes no warranties, implied or otherwise, other than as provided by applicable law.

limited liability

SU-TON expressly excludes any liability for consequential or incidental damages. Except as otherwise provided by Chinese law, SU-TON's liability is limited to and shall not exceed the amount paid by the customer.

Product Acceptance and Returns

Upon receipt, the goods shall be inspected to confirm that they are free of defects. In the case of obvious defects, the consignee shall notify us in writing within 3 days at the latest after receipt of the goods, and in the case of hidden defects, as soon as possible. If the goods are damaged due to transport, we shall also be notified in order to prevent us from claiming our rights against the transport company.

Product suitability and legal attribution

The customer is responsible for the selection, installation and suitability of the product SU-TON endeavours to ensure that the product complies with applicable laws, but makes no warranty with respect to the laws governing the selection, installation and suitability of the product. You should consult the relevant laws and regulations before selecting a product. The customer agrees that the use of the purchased product does not violate Chinese law and other applicable laws.

nothing can be done about it

nothing can be done about it--SU-TON shall not be liable for any delay or inability to perform, in part or in whole, due to acts of God, labour unrest, shortages, unavailability of products, supplies or raw materials, adverse weather conditions, or any other circumstance or cause beyond the control of SU-TON in the conduct of its business.

Cancellation of orders--Cancellations are subject to SU-TON's approval and may be subject to re-stocking and other charges.

Complete agreements and transfers-These Terms and SU-TON's forms, confirmations, quotations, invoices, the terms and conditions contained in the Website and the terms of sale of the Product Catalogue are incorporated into this Agreement by reference.
